Personal data protection treatment policy of Baquianos Travel & Adventure holders

In compliance with the provisions of Statutory Law 1581 of 2012 and its Regulatory Decree 1377 of 2013, BAQUIANOS TRAVEL & ADVENTURE adopts this policy for the processing of personal data, which will be informed to all holders of the data collected or that in the future may turn to commercial management, contractual commitments and meet the standards applicable to suppliers and contractors, including but not limited to tax and commercial.

In this way, BAQUIANOS TRAVEL & ADVENTURE states that it guarantees the rights of privacy, good name and autonomy, in the processing of personal data, and consequently all its actions will be governed by the principles of legality, purpose , freedom, truthfulness or quality, transparency, access and restricted circulation, security and confidentiality.

Everyone who, in the development of different contractual, commercial, labor activities, among others, whether permanent or occasional, will be able to provide BAQUIANOS TRAVEL & ADVENTURE with any type of information or personal data, may know, update and rectify it.

III. AREA OF APPLICATION

 

This policy will be applicable to personal data registered in any database of BAQUIANOS TRAVEL & ADVENTURE whose owner is a natural person.

 

IV. DEFINITIONS

For the purposes of this policy and in accordance with current regulations on the protection of personal data, the following definitions will be taken into account [1].

Authorization: Prior, express and informed consent of the Holder to carry out the Processing of personal data.

Privacy notice: Verbal or written communication generated by the Responsible, addressed to the Holder for the processing of their personal data, by means of which they are informed about the existence of the information processing policies that will be applicable to them, how to access to them and the purposes of the treatment that is intended to give personal data.

Database: Organized set of personal data that is subject to processing.

Cause: person who has succeeded another because of his death (heir).

Personal data: Any information linked or that may be associated with one or more specific or determinable natural persons.

Public data: It is the data that is not semi-private, private or sensitive. Public data are considered, among others, data relating to the marital status of people, their profession or trade and their status as merchant or public servant. By their nature, public data may be contained, among others, in public records, public documents, official gazettes and newsletters and duly enforced judicial sentences that are not subject to reservation.

Sensitive data: Sensitive data means those that affect the privacy of the Holder or whose improper use can generate discrimination, such as revealing racial or ethnic origin, political orientation, religious or philosophical beliefs, membership in unions, social organizations, human rights or that promotes the interests of any political party or that guarantees the rights and guarantees of opposition political parties, as well as data related to health, sexual life, and biometric data.

Person in charge of the Treatment: Natural or legal person, public or private, that by itself or in association with others, performs the Processing of personal data on behalf of the Person Responsible for the Treatment.

Responsible for the Treatment: Natural or legal person, public or private, that by itself or in association with others, decides on the basis of data and / or the Treatment of the data.

Owner: Natural person whose personal data is subject to Treatment.

Treatment: Any operation or set of operations on personal data, such as the collection, storage, use, circulation or deletion.

Transfer: the transfer of data takes place when the person in charge and / or in charge of the processing of personal data, located in Colombia, sends the information or personal data to a recipient, who in turn to be responsible for the processing and is inside or outside from the country.

Transmission: processing of personal data that implies the communication of the same within or outside the territory of the Republic of Colombia when it is intended to carry out a treatment by the person in charge of the person responsible.

 

V. PRINCIPLES

 

In order to guarantee the protection of personal data, BAQUIANOS TRAVEL & ADVENTURE will apply the following principles in a harmonious and comprehensive manner, in light of which the processing, transfer and transmission of personal data must be carried out [2]:

Principle of legality regarding data processing: Data processing is a regulated activity, which should be subject to the current and applicable legal provisions governing the subject.

Principle of purpose: the activity of the processing of personal data carried out by BAQUIANOS TRAVEL & ADVENTURE or to which it has access, will obey a legitimate purpose in line with the Political Constitution of Colombia, which must be informed to the respective owner of the personal data.

Principle of freedom: the processing of personal data can only be done with the prior, express and informed consent of the Holder. Personal data may not be obtained or disclosed without prior authorization, or in the absence of a legal, statutory, or judicial mandate that relieves consent.

Principle of truthfulness or quality: the information subject to Processing of personal data must be truthful, complete, accurate, updated, verifiable and understandable. Processing of partial, incomplete, fractional or error-inducing data is prohibited.

Principle of transparency: In the processing of personal data, BAQUIANOS TRAVEL & ADVENTURE will guarantee to the Holder his right to obtain at any time and without restrictions, information about the existence of any type of information or personal data that is of interest or ownership.

Principle of access and restricted circulation: The processing of personal data is subject to the limits derived from their nature, the provisions of the law and the Constitution. Consequently, the treatment may only be done by persons authorized by the holder and / or by the persons provided by law. Personal data, except public information, may not be available on the internet or other means of disclosure or mass communication, unless access is technically controllable to provide restricted knowledge only to holders or third parties authorized under the law. For these purposes the obligation of BAQUIANOS TRAVEL & ADVENTURE, will be on average.

 

Security principle: the information subject to treatment by BAQUIANOS TRAVEL & ADVENTURE, should be handled with the technical, human and administrative measures that are necessary to grant security to the records avoiding their adulteration, loss, consultation, use or unauthorized or fraudulent access.

Kind of person:

Natural: names and surnames, type of identification, identification number, gender, marital status and date of birth, email, financial data (bank accounts).

Legal: Corporate name, NIT, address, telephone, cell phone, email, country, city, financial data (bank accounts).

In both types of person, this information will be necessary to facilitate trips, tours or other services, including preferences such as class of trip or tour, names and surnames of passengers (type of document, document number, date of birth, name, surname, gender, email, nationality, expiration date of the passport), contacts for accident cases, illnesses suffered or any other anomaly (names and surnames, telephone), phobias, allergies, food preferences, certificate of not being under the effect of drugs or substances psychoactive or alcoholic, surgeries performed prior to conducting tours, physical ability to swim and trek and other restrictions.

  • Cardholder data: type of document, document number, telephone, address, email, names, card number, expiration date and bank.
  • Request for quotation: names, surnames, telephone numbers, city and email.
  • Travel or tour information: type of request, destination, departure date, duration, number of adults, number of children, food, additional services, transportation service, budget per person.
  • Contact us: names, surnames, email, subject, message.
  • Online Chat "Tour Operator": name, email, what is your question, how can we help you?
  • Claim request: names, identification number, telephone numbers, email and comments.
  • Report of technical problems: names, surnames, email and comments.

Biometric data: images, video, audio, fingerprints that identify or make our customers, users or anyone who enters or is located or transits in any place that BAQUIANOS TRAVEL & ADVENTURE has implemented devices to capture such information.

This data can be stored and / or processed on servers located in a data processing center, either owned or contracted with suppliers, located in different countries, which is authorized by our customers / users, by accepting this policy of treatment and protection of personal data, as well as its dissemination through social networks belonging to BAQUIANOS TRAVEL & ADVENTURE.

 

Rights of children and adolescents

 

In the processing of personal data, respect for the prevailing rights of minors will be ensured.

The processing of personal data of minors is prohibited, except for those data that are of a public nature, and in this case the treatment must comply with the following parameters:

a. Respond and respect the best interests of minors

b. Ensure respect for the fundamental rights of minors.

It is the task of the State and educational entities of all kinds to provide information and train legal representatives and tutors on the possible risks faced by children and adolescents regarding the improper treatment of their personal data, and provide knowledge about of the responsible and safe use by children and adolescents of their personal data, their right to privacy and protection of their personal information and that of others as well.

 

VII. DUTIES OF BAQUIANOS TRAVEL & ADVENTURE AS RESPONSIBLE AND IN CHARGE OF THE PROCESSING OF PERSONAL DATA

 

BAQUIANOS TRAVEL & ADVENTURE recognizes the ownership that personal data hold people and consequently they can exclusively decide on them. Therefore, BAQUIANOS TRAVEL & ADVENTURE will use the personal data for the fulfillment of the purposes expressly authorized by the owner or by current regulations.

In the treatment and protection of personal data, BAQUIANOS TRAVEL & ADVENTURE will have the following duties, without prejudice to others provided in the provisions that regulate or get to regulate this matter:

a.Guarantee the holder, at all times, the full and effective exercise of the right of habeas data.

b. Request and keep a copy of the respective authorization granted by the owner for the processing of personal data.

c. To duly inform the owner about the purpose of the collection and the rights that assists him by virtue of the authorization granted.

d. Keep the information under the necessary security conditions to prevent its adulteration, loss, consultation, use or unauthorized or fraudulent access.

e. Ensure that the information is truthful, complete, accurate, updated, verifiable and understandable.

F. Timely update the information, taking care of all the news regarding the data of the owner. Additionally, all necessary measures must be implemented so that the information is kept up to date.

g. Rectify the information when it is incorrect and communicate the pertinent.

h. Respect the security and privacy conditions of the holder's information.

i. To process the queries and complaints formulated in the terms indicated by the law.

j. Identify when certain information is under discussion by the owner.

k. Inform at the request of the owner about the use given to their data.

l. Inform the data protection authority when there are violations of security codes and there are risks in the management of the information of the owners.

m. Comply with the requirements and instructions given by the Superintendence of Industry and Commerce on the particular subject.

n. Use only data whose treatment is previously authorized in accordance with the provisions of Law 1581 of 2012.

o. Ensure the proper use of personal data of children and adolescents, in those cases in which the processing of their data is authorized.

p. Register in the database the legend "claim in process" in the way it is regulated by law.

q. Insert in the database the legend "information in judicial discussion" once notified by the competent authority about judicial processes related to the quality of personal data.

r. Refrain from circulating information that is being controversial by the holder and whose blockade has been ordered by the Superintendence of Industry and Commerce.

s. Allow access to information only to people who may have access to it.

t. Use the personal data of the owner only for those purposes for which it is duly authorized and in any case respecting the current regulations on protection of personal data.

 

VIII. AUTHORIZATION AND CONSENT OF THE HOLDER

 

BAQUIANOS TRAVEL & ADVENTURE requires the free, prior, express and informed consent of the owner of the personal data for the treatment of the same, except in cases expressly authorized by law, namely:

a. Information required by a public or administrative entity in the exercise of its legal functions or by court order.

b. Data of a public nature.

c. Cases of medical or sanitary urgency.

d. Treatment of information authorized by law for historical, statistical or scientific purposes.

e. Data related to the Civil Registry of Persons

 

Demonstration of the authorization

The authorization to BAQUIANOS TRAVEL & ADVENTURE for the processing of personal data will be granted by:

  • The holder, who must prove his identity sufficiently by the different means available to him BAQUIANOS TRAVEL & ADVENTURE
  • The owners of the holder, who must prove such quality.
  • The representative and / or proxy of the holder, prior accreditation of the representation or empowerment.
  • Another in favor or whom which the holder has stipulated

 

Means to grant authorization

BAQUIANOS TRAVEL & ADVENTURE will obtain authorization through different means, including physical, electronic and Internet media, or in any other format that in any case allows obtaining consent through unequivocal behaviors through which it is concluded that if it had not been supplied the same by the owner or the person entitled to do so, the data would not have been stored or captured in the database.

The authorization will be requested by BAQUIANOS TRAVEL & ADVENTURE prior to the processing of personal data.

 

Proof of authorization

BAQUIANOS TRAVEL & ADVENTURE will keep the proof of the authorization granted by the owners of the personal data for its treatment, for which it will use the mechanisms available at its disposal at the present time as well as take the necessary actions to maintain the registration of the form and date and on which he obtained this. Consequently, BAQUIANOS TRAVEL & ADVENTURE may establish physical files or electronic repositories made directly or through third parties contracted for this purpose.

 

Revocation of the authorization.

The holders of personal data may at any time revoke the authorization granted to BAQUIANOS TRAVEL & ADVENTURE for the processing of their personal data or request the deletion of the same, as long as it is not prevented by a legal or contractual provision. IX. TREATMENT TO WHICH THE DATA AND PURPOSE OF THE SAME WILL BE SUBMITTED

 

The processing of the personal data of employees, suppliers, customers, or of any person with whom BAQUIANOS TRAVEL & ADVENTURE has established or established a relationship, permanent or occasional, will be carried out in the legal framework that regulates the matter.

Sensitive data

In the case of sensitive personal data, BAQUIANOS TRAVEL & ADVENTURE may use and process them when:

a. The holder has given his explicit authorization, except in cases where the granting of such authorization is not required by law.

b. The treatment is necessary to safeguard the vital interest of the Holder and if he/she is physically or legally incapacitated. In this case, legal representatives must grant their authorization.

c. The treatment is carried out in the course of legitimate activities and with due guarantees by a foundation, NGO, association or any other non-profit organization, whose purpose is political, philosophical, religious or trade union, provided they refer exclusively to its members or to people who maintain regular contacts because of their purpose. In these events, the data cannot be provided to third parties without the authorization of the owner.

d. The Treatment refers to data that are necessary for the recognition, exercise or defense of a right in a judicial process.

e. The Treatment has a historical, statistical or scientific purpose. In this event, the measures leading to the deletion of the identity of the owners must be adopted.

Without prejudice to the exceptions provided by law, the processing of sensitive data requires the prior, express and informed authorization of the owner, which must be obtained by any means that may be subject to subsequent consultation and verification.

 

X. PRIVACY NOTICE

 

The Privacy Notice is the physical document, electronic or in any other format, made available to the owner to inform him about the processing of his personal data. Through this document, the owner is informed of the existence of the information processing policies of BAQUIANOS TRAVEL & ADVENTURE and that will be applicable, how to access them and the characteristics of the treatment that is intended to be given to Personal information.

The privacy notice must contain at least the following information:

XI. GUARANTEES OF THE RIGHT OF ACCESS

XII. PROCEDURE FOR THE ATTENTION OF CONSULTATIONS, CLAIMS, REQUESTS FOR RECTIFICATION, UPDATE AND DATA DELETE

 

a. Queries:

The holders or their successors may consult the personal information of the holder that is with BAQUIANOS TRAVEL & ADVENTURE, who will provide all the information contained in the individual registry or that is linked to the identification of the Holder.

In regard to the attention of requests for consultation of personal data, BAQUIANOS TRAVEL & ADVENTURE guarantees:

  • Enable electronic or other media that it deems appropriate.
  • Establish forms, systems and other simplified methods, which must be informed in the privacy notice.
  • Use the customer service or claims you have in operation.
  • In any case, regardless of the mechanism implemented for the attention of requests for consultation, they will be attended within a maximum term of ten (10) business days from the date of receipt. When it is not possible to attend the query within said term, the interested party will be informed before the expiration of the 10 days, stating the reasons for the delay and indicating the date on which his query will be attended, which in no case may exceed five (5) business days following the expiration of the first term.

b. Claims

The Holder or his successors who consider that the information contained in a database must be subject to correction, update or deletion, or when they notice the alleged breach of any of the duties contained in the law, may file a complaint with BAQUIANOS TRAVEL & ADVENTURE, which will be processed under the following rules:

  1. The claim of the Holder will be made by request addressed to BAQUIANOS TRAVEL & ADVENTURE to the email mercadeo@baquianos.com or by written communication addressed to the department or administrative area, with the identification of the owner, the description of the facts that give rise to the claim, the address, and the documents to be enforced. If the claim is incomplete, the interested party will be required within five (5) days after receipt of the claim to correct the failures. After two (2) months from the date of the request, without the applicant submitting the required information, it will be understood that he has given up the claim. In the event that the person receiving the claim is not competent to resolve it, they will transfer it to the corresponding party within a maximum period of two (2) business days and inform the interested party of the situation.
  2. Once the complete claim is received, it will be cataloged with the label "claim in process" and the reason for it, in a term not exceeding two (2) business days. This label will be maintained until the claim is decided.
  3. The maximum term to handle the claim will be fifteen (15) business days from the day following the date of receipt. When it is not possible to address the claim within said term, the interested party will be informed of the reasons for the delay and the date on which their claim will be addressed, which in no case may exceed eight (8) business days following the expiration of the first finished.

 

c. Request for update and / or rectification

BAQUIANOS TRAVEL & ADVENTURE will rectify and update, at the request of the holder, the information that turns out to be incomplete or inaccurate, in accordance with the procedure and the terms indicated above, for which it will be taken into account:

  1. The owner must submit the request to the email mercadeo@baquianos.com or physically addressed to the Marketing department indicating the update and / or rectification to be made and will provide the documentation that supports your request.
  2. BAQUIANOS TRAVEL & ADVENTURE may enable mechanisms that facilitate the exercise of this right to the holder provided, that they benefit. Consequently, electronic or other means may be enabled that they deem pertinent, which will be informed in the privacy notice and will be made available to those interested on the website www.baquianos.com.

 

d. Data Deletion Request

The owner of the personal data has the right to request BAQUIANOS TRAVEL & ADVENTURE its deletion in any of the following events:

  1. Consider that they are not being treated in accordance with the principles, duties and obligations set forth in current regulations.
  2. They are no longer necessary or relevant for the purpose for which they were collected.
  3. The period necessary for the fulfillment of the purposes for which they were collected has been exceeded

This deletion implies the total or partial elimination of personal information as requested by the owner in the records, files, databases or treatments carried out by BAQUIANOS TRAVEL & ADVENTURE. However, this right of the owner is not absolute and consequently BAQUIANOS TRAVEL & ADVENTURE may deny its exercise when:

a. The holder has a legal or contractual duty to remain in the database.

b. The elimination of data hinders judicial or administrative actions related to tax obligations, the investigation and prosecution of crimes or the update of administrative sanctions.

c. The data is necessary to protect the legally protected interests of the holder; to perform an action based on the public interest, or to fulfill an obligation legally acquired by the holder.

 

XIII NATIONAL DATABASE REGISTRATION

 

BAQUIANOS TRAVEL & ADVENTURE, reserves the right to maintain and catalog certain information that rests in its databases or databases, in the events contemplated in the law and in its internal regulations and regulations, as confidential in accordance with current regulations.

BAQUIANOS TRAVEL & ADVENTURE, will proceed in accordance with current regulations and regulations issued by the National Government for the purpose of registering their databases, before the National Registry of Databases (RNBD) that will be administered by the Superintendence of Industry and Commerce. XIV INFORMATION SECURITY AND SECURITY MEASURES

 

In compliance with the security principle established in the current regulations, BAQUIANOS TRAVEL & ADVENTURE will adopt the technical, human and administrative measures that are necessary to grant security to the records avoiding their adulteration, loss, consultation, use or unauthorized or fraudulent access.

 

XV. USE AND INTERNATIONAL TRANSFER OF PERSONAL DATA AND PERSONAL INFORMATION BY BAQUIANOS TRAVEL & ADVENTURE

 

In compliance with the mission of BAQUIANOS TRAVEL & ADVENTURE, and taking into account the nature of the permanent or occasional relationships that any person holding personal data may have with BAQUIANOS TRAVEL & ADVENTURE, the holder may carry out the transfer and transmission, even international, of the all personal data, as long as the applicable legal requirements are met; and consequently the holders with the acceptance of this policy, expressly authorize to transfer and transmit, even internationally, personal data. The data will be transferred, for all relationships that can be established with BAQUIANOS TRAVEL & ADVENTURE.

For the international transfer of personal data of the owners, BAQUIANOS TRAVEL & ADVENTURE will take the necessary measures so that third parties know and agree to observe this policy, under the understanding that the personal information they receive, can only be used for matters directly related to BAQUIANOS TRAVEL & ADVENTURE and only while it lasts and cannot be used or intended for a different purpose. For the international transfer of personal data, the provisions of article 26 of Law 1581 of 2012 will apply

International transmissions of personal data by BAQUIANOS TRAVEL & ADVENTURE, will not require to be informed to the owner or have their consent when there is a contract for the transmission of personal data in accordance with article 25 of Decree 1377 of 2013.

 

BAQUIANOS TRAVEL & ADVENTURE, may also exchange personal information with government or other public authorities (including, among other judicial or administrative authorities, tax authorities and criminal, civil, administrative, disciplinary and fiscal investigation agencies), and third parties involved in proceedings civil legal entities and their accountants, auditors, lawyers and other advisors and representatives, because it is necessary or appropriate: (a) to comply with current laws, including laws other than those in your country of residence; (b) to comply with legal processes; (c) to respond to requests from public and government authorities, and to respond to requests from public and government authorities other than those of your country of residence; (d) to enforce our terms and conditions; (e) to protect our operations; (f) to protect our rights, privacy, security or property, yours or those of third parties; and (g) obtain the applicable compensation or limit the damages that may affect us.

 

XVI. RESPONSIBLE AND IN CHARGE OF THE PROCESSING OF PERSONAL DATA

BAQUIANOS TRAVEL & ADVENTURE will be responsible for the processing of personal data.

 

XVII. VALIDITY

This policy is effective as of June 26, 2019 and leaves without effect the regulations or special manuals that could have been adopted by administrative instances in BAQUIANOS TRAVEL & ADVENTURE
